Terms of Use

1. Acceptance of Terms

By accessing or using the MVPeeps mobile application, website, or related services (collectively, the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to coaches, parents, guardians, athletes, organization administrators, and any other users invited to or using MVPeeps.

2. Description of Service

MVPeeps is a youth sports team and athlete development platform provided by Full Tilt Industries LLC (the "Company," "we," "us," or "our"). The App helps teams and organizations manage athlete profiles, rosters, events, feedback, focus areas, goals, invitations, and communications.

The App may include:

• Coach, parent, athlete, and organization administrator accounts
• Team, roster, season, class, and membership management
• Athlete development tracking, skills, focus areas, feedback, goals, and badges
• Calendar events, RSVPs, snack or volunteer signups, event notes, and activity feeds
• Direct messages, team messages, comments, reactions, and media uploads
• Email, SMS, push, and in-app notifications for team, invite, feedback, and event updates

3. Eligibility and Accounts

3.1 Account Registration

You must provide accurate, current, and complete account information. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Parents, Guardians, and Athletes

Parents or legal guardians may create and manage athlete profiles for children. Coaches and organization administrators may create or manage team and roster information where authorized by a team, organization, parent, or guardian.

The App is not intended to collect personal information directly from children under 13 without parent or guardian involvement.

3.3 Organization and Team Access

If you use MVPeeps on behalf of a team, club, school, or sports organization, you represent that you have authority to use the App and manage related team or athlete information.

4. Notifications and Communications

4.1 Program Description

By enabling notifications or providing contact information, you may receive communications from MVPeeps related to:

• Team invitations and invite links
• Coach feedback, focus area comments, and athlete development updates
• Upcoming events, RSVP reminders, schedule changes, and volunteer needs
• Team messages, direct messages, comments, reactions, and activity updates
• Account, security, support, legal, or service notices

4.2 Consent and Opt-Out

• You may allow or deny push notifications through your device settings.
• You may opt out of non-essential email or SMS communications where available.
• For SMS messages, reply STOP where supported or contact support.
• Consent to receive marketing communications is not a condition of purchase.

5. Fees, Subscriptions, and Payments

MVPeeps may offer free, paid, team, club, or organization-level plans. Paid features, pricing, billing periods, renewal terms, cancellation rights, and refund handling will be disclosed at the point of purchase or in an applicable order form, app store listing, or subscription screen.

Payments may be processed by third parties such as Apple, Google, Stripe, RevenueCat, or other payment providers. We do not store full payment card details.

6. Acceptable Use

You agree not to use the App to:

• Harass, threaten, abuse, or impersonate another person
• Post or send unlawful, harmful, hateful, explicit, or exploitative content
• Upload media or messages that violate privacy, publicity, or intellectual property rights
• Access athlete, team, or organization data without authorization
• Interfere with App security, authentication, data storage, or messaging systems
• Reverse-engineer, disassemble, scrape, or attempt to derive source code or private APIs
• Use invitations, SMS, email, or messaging tools for spam or unsolicited marketing
• Use the App for any illegal purpose

We may suspend or terminate accounts that violate these Terms or create risk for other users, teams, athletes, or the Company.

7. User Content and Team Data

You retain responsibility for information you submit to the App, including team names, athlete profiles, event details, comments, messages, photos, videos, feedback, goals, and other content ("User Content").

You grant the Company a limited license to host, store, process, display, transmit, and use User Content as needed to operate, secure, support, and improve the App.

You represent that you have the rights and permissions needed to submit User Content, including athlete information and media involving minors.

8. Intellectual Property

The App, including its software, design, workflows, branding, logos, graphics, text, and user interface, is owned by Full Tilt Industries LLC or its licensors. You receive a limited, non-exclusive, non-transferable right to use the App as permitted by these Terms.

You may not copy, modify, distribute, sell, rent, lease, or create derivative works from the App except as expressly permitted by law or by written permission from the Company.

9. Privacy

Our Privacy Policy explains how we collect, use, protect, and disclose information. By using MVPeeps, you acknowledge that you have read and understood the Privacy Policy.

10. Third-Party Services

The App may rely on third-party services, including Firebase and Google Cloud services, Apple and Google app stores, Google Maps, Twilio, SendGrid or other email providers, payment processors, and analytics, storage, messaging, notification, or hosting providers.

We are not responsible for outages, errors, policy changes, or service interruptions caused by third-party providers.

11. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, secure, or available at all times.

MVPeeps is a team communication and athlete development tracking tool. It does not provide medical, legal, psychological, safeguarding, coaching-certification, or emergency services advice. Coaches, parents, guardians, and organizations remain responsible for athlete safety, supervision, and compliance with applicable rules and laws.

12. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, business interruption, or reputational harm.

To the maximum extent permitted by law, our total liability for any claim relating to the App is limited to the amounts you paid to us for the App during the 12 months before the claim, or $100 if you paid nothing directly to us.

13. Termination

You may stop using the App at any time. We may suspend or terminate access if you violate these Terms, misuse team or athlete data, create security risk, fail to pay applicable fees, or use the App in a way that may harm users, athletes, teams, organizations, or the Company.

After termination, we may retain or delete data as described in the Privacy Policy and as required by law, legitimate business needs, or contractual obligations.

14. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted in the App or on our website. We may provide notice of material changes by email, in-app notice, or other reasonable means.

Your continued use of the App after changes become effective means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any legal disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona, unless applicable law requires otherwise.
